Terms of Use

These Terms of Use (“Terms”) govern the conditions of use for the app “CinchCat” (“the App”), provided by System-Neco(“the Company”). Customers (“you”) agree to use the App in accordance with these Terms.

Article 1 (Application)

These Terms apply to all relationships between you and the Company regarding the use of the App. The Company may establish various rules and conditions (“Specific Provisions”) for use. These Specific Provisions form part of these Terms. In the event of a conflict between these Terms and any Specific Provisions, the Specific Provisions will take precedence unless otherwise specified.

Article 2 (Registration)

The App does not require user registration before use. You can use all features of the App without registering, and thus, your personal information such as name and email address is not collected or managed by the Company.

Article 3 (Prohibited Actions)

You must not engage in the following actions while using the App:

Acts that violate laws, regulations, or public order and morals
Acts related to criminal activity
Infringing on intellectual property rights such as copyrights and trademarks of the App’s content
Disrupting the servers or network functions of the Company, other customers, or third parties
Commercial use of information from the App
Interfering with the operation of the Company’s services
Unauthorized access or attempts thereof
Collecting or storing other customers’ personal information
Using the App for fraudulent purposes
Actions that disadvantage or harm other customers or third parties
Impersonating other customers
Advertising, soliciting, or conducting business without the Company’s permission
Seeking relationships with strangers of the opposite sex
Providing benefits to antisocial forces
Any other actions deemed inappropriate by the Company

Article 4 (Suspension of Service)

The Company may suspend or interrupt the provision of the App without prior notice to you due to:

Maintenance, inspection, or updating of the computer system
Difficulty in providing services due to force majeure
Interruption due to computer or communication line accidents
Other circumstances deemed difficult to provide services

The Company is not responsible for any disadvantages or damages incurred by you or third parties due to the suspension or interruption of service.

Article 5 (Restriction of Use and Cancellation of Registration)

The Company may restrict your use of the App or cancel your registration without prior notice if:

You violate any provision of these Terms
False information in your registration details is discovered
There is no response to communications from the Company within a specified period
There has been no use of the App for a certain period
The Company deems the use inappropriate for any other reason

The Company is not liable for any damages incurred by you based on actions taken under this article.

Article 6 (Withdrawal)

You can delete the App at any time. Since the App does not implement a user registration feature, there is no management of data related to accounts.

Article 7 (Disclaimer of Warranty and Limitation of Liability)

The Company disclaims all responsibility for any circumstances arising from the use of the App, including but not limited to:

The App is provided “as is” without warranty of any kind, including but not limited to the warranties of merchantability, fitness for a particular purpose, or non-infringement.
The Company will not be liable for any damages arising from the use of the App. However, this disclaimer does not apply if the contract between the Company and you regarding the App is deemed a consumer contract under the Consumer Contract Act.
The Company is not responsible for the content of banner ads displayed on the App or for products and services provided through advertisements. The responsibility for the content of advertisements lies with the advertisers, and the App does not guarantee the accuracy or reliability of advertisement content.
The Company is not liable for damages arising from its negligence (except for gross negligence) in fulfilling obligations or from tort. Compensation for damages caused by the Company’s negligence (excluding gross negligence) or tort to you is limited to the amount of usage fees received from you in the month in which the damage occurred.
The Company is not responsible for transactions, communications, or disputes between you and other customers or third parties regarding the App.

Article 8 (Changes to Service Content)

The Company may change the content of the App or discontinue its provision without notice to you, and will not be liable for any damages incurred by you as a result.

Article 9 (Amendment of Terms)

The Company may amend these Terms at any time as deemed necessary. If you start using the App after such amendments, you are deemed to have agreed to the amended Terms.

Article 10 (Handling of Personal Information)

The Company will appropriately handle personal information obtained through the use of the App in accordance with its “Privacy Policy.”

Article 11 (Copyrights)

Unauthorized reproduction or redistribution of text, images, videos, and other copyrighted materials posted on the App is prohibited.

Article 12 (Notifications or Communications)

Notifications or communications between you and the Company will be conducted in accordance with the methods specified by the Company. The Company will consider the current contact information registered as valid for communications.

Article 13 (Prohibition of Transfer of Rights and Obligations)

You may not transfer or provide as collateral your status in the service agreement or rights and obligations under these Terms to a third party without the prior consent of the Company.

Article 14 (Governing Law and Jurisdiction)

These Terms shall be governed by the laws of Japan. Any disputes related to the App will be subject to the exclusive jurisdiction of the court where the Company’s headquarters is located.
