These Terms of Service (the “Terms”) set out the conditions for using Greeting Cat (the “App”), provided by System Neco (the “Operator”). Please read and agree to these Terms before using the App.

Article 1 — Scope

These Terms apply to the relationship between you and the Operator concerning use of the App. If the Operator establishes additional conditions for individual features, their scope and content will be clearly stated in the App or on its related website. Any change to these Terms will follow the procedure in Article 12.

Article 2 — Registration and operating environment

The App does not require a user account, login with an ID and password, or an account withdrawal procedure. You are responsible for providing and managing your device, network connection, and necessary permissions. You are responsible for communication charges.

Available features, display, and behavior may differ depending on the device model, OS version, settings, available storage, and network conditions, even on supported devices and operating systems. If you do not grant permissions such as location, camera, photo-library, or notification access, some related features may be unavailable.

Article 3 — Features and the nature of the information provided

The App provides weather information and greetings, photo and video editing and sharing, Weather memos, Omikuji, reminders, and other features. Features may differ depending on the app version and operating environment.

Weather information is based on data retrieved from an external service. It may differ from actual conditions or appear late because of the selected location, retrieval and update times, network conditions, or other factors. Its accuracy, completeness, and timeliness are not guaranteed at all times. Do not rely solely on this App for disaster preparedness, evacuation, medical decisions, mountaineering, or other safety-related decisions. Check the latest information from public authorities and other appropriate sources.

Weather memos and greetings are intended for everyday weather checks and conversation. They do not constitute professional advice or a guarantee of safety. Omikuji is for entertainment and does not predict or guarantee future events or outcomes.

Reminders use your device’s notification system. Notifications may be missed or delayed because of permissions, OS power-saving settings, device state, or other factors. Use other methods as well for appointments or events that require reliable notification.

Article 4 — Photos, videos, text, and sharing

Use only photos, videos, text, and other material that you own the rights to or have the necessary permission to use. Do not use or share material that infringes another person’s copyright, rights relating to their image, privacy, or other rights.

Rights in the photos, videos, and text you bring into the App remain with you or the original rights holder. They do not transfer to the Operator simply because you use the App.

You may post or send greeting images and videos created using the App’s normal sharing features to social media, messaging apps, and similar services for personal greetings and communication. Within this scope, including the App’s display or Operator-provided material in those images or videos is not subject to the copying and republication prohibition in Article 5. However, material you supply and information from external services remain subject to the relevant rights holders’ permissions and applicable conditions.

If shared images, videos, or text include place names, weather information, other people’s faces, or similar content, that content is also sent to the destination. Check the content and recipient before sharing. Check the destination service for its visibility settings and deletion methods.

Article 5 — Intellectual property and permitted use

Rights in the App’s software, design, and Operator-provided text, images, videos, audio, and other material belong to the Operator or the relevant rights holder. Information from external services, map data, third-party material, and open-source software are subject to their respective terms and licenses.

Except for normal sharing under Article 4, uses permitted by law or the applicable licenses, or uses separately authorized by the Operator, you may not copy, republish, redistribute, or sell the App or provided material without permission. Contact the Operator in advance about distributing or selling extracted material on its own, or commercially using information obtained through the App or Operator-provided material. This provision does not give the Operator rights in your own material.

Article 6 — Prohibited conduct

When using the App, you must not:

  • Violate laws or public order and morals, or facilitate criminal activity.
  • Infringe the copyright, trademark rights, rights relating to a person’s image, privacy, or other rights of the Operator or a third party.
  • Unlawfully obtain or disclose another person’s personal information, impersonate others, or engage in fraud, threats, defamation, or other conduct that harms others.
  • Interfere with the normal operation or use of the App or related services through unauthorized access, malware distribution, manipulation of communications or features, excessive load on external services, or similar conduct.
  • Republish, redistribute, sell, or otherwise use the App, material, or information without authorization in breach of these Terms or other applicable conditions.
  • Provide benefits to organized crime groups or other antisocial forces, or otherwise support their activities.

Article 7 — External services and advertising

The App uses external services for weather retrieval, maps, advertising, usage analytics, and other functions. Some features may become unavailable if an external service stops operating or changes its specifications or conditions. When using external services or linked websites, also review the conditions set by their providers.

The App displays advertisements. Where viewing or displaying an ad enables a feature, its conditions are shown in the App. Ads may not always be available to display or watch. The terms for transactions involving products or services offered through ads or linked websites are determined between you and the relevant provider.

Article 8 — Data storage and ending use

In-app data, including photos, videos, saved locations, display settings, and reminders, is stored mainly on your device. The App is not a data storage or recovery service provided by the Operator. Keep originals of important photos and videos separately from the App.

Data may be lost or become unusable because of device failure, loss, OS changes, deletion of the App, insufficient storage, or other circumstances. Whether device or OS backup and restoration are available depends on their settings and services.

You may stop using the App and delete it from your device at any time. Deleting the App may not delete originals in your photo library, data sent to sharing destinations, device backups, or information retained by external services. See also the Privacy Policy for information handling details.

Article 9 — Feature changes, interruption, or discontinuation

The Operator may change features, interrupt the App, or discontinue it for reasonable reasons, including improvements, bug or security fixes, and changes to external services or operating systems. Changes or discontinuation with a significant effect on users will be announced in the App or on its related website in advance wherever possible. Where advance notice is impracticable, such as during an outage or emergency response, notice will be provided afterward to the extent practicable.

This article does not exempt the Operator from liability imposed by law. Liability associated with changes, interruption, or discontinuation is governed by the next article and applicable law.

Article 10 — Warranties and liability

The Operator works to improve the App’s quality but does not guarantee that it will be free of faults or interruptions, operate identically on every device or OS, or meet your particular purpose.

If you suffer damage for a cause attributable to the Operator, the Operator will be liable in accordance with the Civil Code of Japan, the Consumer Contract Act of Japan, and other applicable laws. These Terms do not categorically exempt the Operator from liability for intentional or negligent acts, nor do they automatically set compensation at zero because the App is free to use.

If a dispute arises between you and a third party over shared content, external services, or similar matters, the parties concerned should seek to resolve it. This provision does not exempt the Operator from liability imposed by law for causes attributable to the Operator.

Article 11 — Handling user information

The Operator handles information processed by the App in accordance with the separate Privacy Policy. See that policy for details about location information, photos and videos, advertising, usage analytics, and transmission of information to external services.

Article 12 — Changes to these Terms

The Operator may change these Terms to the extent permitted by law, including where a change benefits users generally, or is consistent with the purpose of the contract and reasonable in light of its necessity, the appropriateness of the revised terms, and other circumstances.

When changing these Terms, the Operator will announce the change, the revised content, and the effective date in the App or on its related website. Where the law requires notice before the effective date or individual consent, those procedures will be followed. Continued use alone will not be treated as obtaining consent required by law.

Article 13 — Notices and contact

General notices about the App will be posted in the App or on its related website. Individual inquiries will be answered using the email address you provide or another method necessary for communication.

Article 14 — Severability

If any part of these Terms is found invalid or unenforceable under applicable law, the remaining provisions continue to apply to the extent lawful. Mandatory consumer-protection provisions and other applicable laws take precedence over these Terms.

Article 15 — Governing law and jurisdiction

These Terms are governed by and interpreted under Japanese law. This does not exclude protections provided by mandatory consumer-protection laws applicable to you. Disputes concerning the App will be resolved by a court with jurisdiction under applicable law.
